Terms and Conditions for ‘The Activity People Limited’ and all it’s associated companies

BOOKING PROCESS

  1. Bookings can be made by telephone or securely online through any of our websites. The bookings department can also be contacted by email on: bookings@theactivitypeople.co.uk, or by post to our Head Office at: The Activity People, Go Ballistic House, 52 Chatsworth Road, Harrogate, HG1 5HS
  2. If you have made your booking via the telephone, you will receive an email from your Sales Consultant confirming the details of your booking. You must respond to this email in order to activate your booking.
  3. If you have booked online, you will not receive an activation email as your booking is automatically activated.
  4. We require no less than £14.99 deposit per person to place your booking. This deposit can vary and is activity dependant. When booking online the minimum deposit is taken automatically. This deposit prevents others from booking this sporting event on a specific time on a specific date and is therefore non-refundable at the point the deposit is paid. This complies with Regulation 6 within the Distance Selling Regulations issued by the Office of Fair Trading.
  5. The balance amount is due no less than 31days prior to the date of your booking. If an online booking is placed within 31 days of the requested booking date full payment is taken automatically if we can place your event.
  6. If you have paid your deposit by card, this balance will automatically be taken from the same card unless you advise us otherwise at 31 days prior to your event. If you wish to pay the balance by any other means this must be received by us no less than 31 days prior to the date of your booking. No reminders are issued. Your booking will be automatically cancelled and you will lose your deposit if your balance payment is not received on or before this deadline.
  7. On receipt of your first payment and receipt of your activation email, you will receive a confirmation of your booking together with all other documentation in connection with your booking (e.g. directions to the venue). If you have placed a booking, have activated your booking by a return email to your Sales Consultant, and subsequently do not receive confirmation and receipt for payment, please email admin@theactivitypeople.co.uk outlining your booked details.
  8. Once payment is taken, and your have activated your booking, your booking is confirmed under the terms and conditions you have read and accepted and cancellation will be dealt with as follows:

CANCELLATION CHARGES

Once your booking is confirmed, your right to cancel without penalty ends as designated by The Office of Fair Trading as we have booked you into a sporting event at a specific date at a specific time. Therefore the terms of cancellation are as follows:

Once a booking is confirmed – loss of deposit 31 days or more prior to the event – Full refund of monies paid less the minimum deposit of £14.99 a person. 30 days or less prior to the event – No refund.

Our accepted date of cancellation is the date that your written cancellation is acknowledged in writing by The Activity People. If catering or any other supply is included in the package, this may also be subject to cancellation charges. No verbal cancellations are accepted. Cancellations must be sent to admin@theactivitypeople.co.uk or to our Head Office at: The Activity People, Go Ballistic House, and 52 Chatsworth Road, Harrogate, HG1 5HS

The 31 day rule includes weekends and bank holidays

Any reduction in numbers must also be confirmed in writing and acknowledged in writing by The Activity People to be considered valid. Verbal changes are not accepted. Cancellation charges as above apply in the event of a reduction in numbers.

If a venue cancels due to bad weather, your booking will be rescheduled to a mutually convenient date for up to three months after the original booked date. If we are unable to re-schedule your booking a full refund will be given. If you do not accept a re-scheduled date within this timeframe we will provide a full refund of monies paid less your deposit. Bookings at all-weather venues will not be eligible for a refund if the venue is prepared to run the session. Customer cancellation in this instance will be treated as a normal cancellation and stated charges will apply.

CHANGES / CANCELLATIONS ON GROUP BOOKINGS

Discounted bookings for large groups are priced on the number of participants. A large group is classed at 25 participants and over. Should you reduce your group size at any time prior to the event your booking will be re-priced accordingly.In addition to re-pricing, cancellation charges, as outlined above, apply to each person that is cancelled in a group booking.

An existing booking that does not qualify for a discount at the time of booking cannot automatically change this status by the addition of extra participants at a later date.

A booked ‘team’ classified event can have further teams added to their booking if there is availability but cannot increase their existing team sizes at a later date.

ARRIVING LATE

All our venues require participants to be ready to take part in the activity 30 minutes or at the very latest 15 minutes prior to a designated ‘start-time’ to enable a full safety briefing to take place. The time stated on your confirmation is this important ‘arrival time’ and not the ‘start time’. All our venues will do their best to accommodate late arrivals but this cannot be guaranteed, especially during busy periods. It is unlikely that customers will be allowed to participate if they have missed the pre-session briefing and safety talk. Some of our venues will make an exception to this and provide individual safety talks and briefings, but this in entirely at the individual venue's discretion and cannot be guaranteed. The booking will normally be treated as a cancellation in the event of late arrival with the loss of all monies.

EXCLUSION FROM VENUE

The host venue has the right, at all times, to refuse participants access to the booked activity at any stage of the booking and remove them from their venue if in their opinion the participants are under the permitted age; are the incorrect height or weight; are unfit to take part in the activity because of physical or mental impairment; be under the influence of alcohol or drugs; have arrived too late to take part in the pre-activity briefing; consider them to be a danger to themselves, other participants or members of staff ; or are displaying aggressive and abusive behaviour (verbal or physical). If any of these occurrences apply, the booking will have been deemed to have been cancelled and full cancellation charges will apply.

Should any participant damage the property of the venue of verbally or physically injure a member of the staff or other participants, they will be dealt with by the venue management accordingly and may face prosecution by the venue. The Activity People will not become involved in such matters other than to supply the necessary authorities with contact details of the offending party / parties. Any communications relating to such matters should be conducted between the venue, the offending party / parties and the authorities.

PERSONAL SAFETY

Whilst all our activities are as safe as they can be, safety instructions must be followed at all times as well as any instructions from the instructors or marshals on the day. You are advised not to attempt to go beyond your capabilities or engage in risky or daring behaviour. All physical activities by definition involve an element of risk so it is a given that you undertake the activity with the full understanding of this and accept responsibility for your own safety and the risks involved in taking part. In the case of more than one person taking part under one booking it is a given that the person booking the group with us has relayed the details of the activities to the group and that the individuals in the group have acknowledged the possible risks involved and that they have agreed to take part on this basis. All our venues carry public liability insurance, however you are advised to ensure that your personal insurance cover is up to date and that you are covered for taking part in such activities.

ACTIVITIY DESCRIPTIONS

All the activities featured on our websites are described in as much detail as possible and are correct at the time each booking is made. From time to time activities do change both in price, type and duration. When The Activity People receive notification of any changes they are then changed on our websites accordingly as soon as possible. Should these changes make a significant change to the product that will be delivered to an existing customer they will be informed accordingly. If the change involves a different format of the same activity then we do not consider this to be significant, providing the participant receives the same or more time taking part in the activity.

Our Sales Consultants will make every effort to provide additional information and clarification about any of our featured activities, however customers are deemed to have familiarised themselves with the activity description and all its restrictions as on our websites before booking the product. No responsibility can be accepted by The Activity People if you do not familiarise yourself with all aspects of the activity in question at the venue chosen, as described on our website, before placing a booking.

If on arrival at the venue chosen the activity booked is not available for whatever reason you may be offered an alternative activity by the venue. Your acceptance and participation of the alternative activity is an acceptance on your part that the replacement activity is an entire and acceptable replacement of the original booked activity.

LATE START

Due to the nature of our activities, unforeseen circumstances can delay the start of an event. In all cases the venue will endeavour to minimise your inconvenience and will offer you a later start time or, in some cases, an alternative date. The action taken will be dependant on the circumstances surrounding the situation. As such incidences cannot be predicted your understanding is appreciated. Should you choose not to accept the alternative time offered to you and do not take part in the activity, either on the same date or the alternative date no other recompense will be offered from The Activity People. All communications as a result of such circumstances should be with the venue directly as it will be deemed that The Activity People have fulfilled their booking with you and that a new contract / agreement was entered into between you and the supplier in question.

VOUCHERS

Vouchers can be purchased for any of our activities. All customers receive the original voucher by post. If you do not receive your voucher in the post you must contact us immediately. If you do not contact us within 30 days of purchasing your voucher in this regard, it will be deemed that you are in possession of your voucher and any subsequent request for a duplicate will not be considered. Should a duplicate be issued within 30 days and the original is presented for redemption, the duplicate will become invalid immediately.

An expiry date is printed on all vouchers. Vouchers must be posted to our address below to arrive on or before the expiry date. The original, in good condition and with no alterations is valid for redemption. Damaged vouchers, duplicates or copies of any kind are unacceptable. Vouchers are irreplaceable therefore we recommend that they are stored safely and that you use a recorded mail delivery service when posting them for redemption. No responsibility can be accepted by The Activity People for lost vouchers in any circumstances. Redemption of a lost voucher is not available in any circumstances. Should a voucher be lost in the post when posted to The Activity People, it is the sender who has the responsibility to track the lost post in all circumstances.

Please provide all your contact details when you send your vouchers for redemption together with at least two alternate dates and venues preferred unless your voucher is venue specific. Voucher redemption against a particular activity on a particular date is subject to availability at the time of booking and cannot be guaranteed.

If we cannot accommodate you at a particular venue for whatever reason we reserve the right to offer you an alternative activity at the nearest venue. The alternative activity will be the nearest match to the specified activity. If you decide not to take advantage of the alternative we will refund monies paid less a 20% charge. The refund will be paid back onto the card used to purchase the voucher.

I all cases we require the original voucher to be returned to us before the expiry date before any action can be taken. It is your responsibility to ensure the safe delivery of the voucher to The Activity People.

No re-validation of vouchers is available. Once payment is taken for a voucher it cannot be cancelled. No refunds are available for vouchers for which payment has been taken unless we cannot accommodate you as described above in this section. Booking cancellation terms stated above do not apply to vouchers.

COMPLAINTS

If, on arriving at the designated venue, you are dissatisfied with your booked activity, then you must speak to the activity provider on the day. We do not consider it to be reasonable if you have not brought your dissatisfaction to the attention of the activity supplier at the time and then complain later. If you take part in an activity, either the booked activity or a replacement offered by the supplier on the day it is deemed that you consider that the activity of which you took part is entirely acceptable to you and that a complaint at a later date will not be considered reasonable. The Activity People represent a network of activity providers but do not deliver the activities personally. Unless the complaint is in regards to the booking process, all complaints in regards to the quality and provision of the activity must be directed to the provider.

Should you have a genuine complaint against The Activity People please email customer.services@theactivitypeople.co.uk. All communications with Customer Services must be made in writing. This ensures that all aspects of your communication between us are clear and unambiguous.

All bookings will be subject to these same conditions without exception. All customers will have deemed to have made themselves aware of these Terms & Conditions and will have accepted them as part of their booking with The Activity People. No verbal or other communication overrides these terms and conditions in any respect whatsoever.

DATA PROTECTION

The Activity People complies with the principles of the Data Protection Act 1998 and is registered. Those principles require that data be:

  • Fairly and lawfully processed
  • Processed for limited purposes
  • Adequate, relevant and not excessive
  • Accurate
  • Not kept longer than necessary
  • Processed in accordance with the data subject's rights
  • Secure

The Activity People and all its associated companies comply with regulations and guidelines as laid down by the Office of Fair Trading and Trading Standards for the service we offer.

TRADEMARKS & BRAND NAMES

The Activity People and all its associated brands are well-known within the UK and have acquired both registered and unregistered rights in our trademarks, domain names and our logos. No one may use our names, trademarks, domain names or logos without our express written permission. Our network of venues may apply to display our 'Network Signage' at their venue to facilitate easier identification of the location for customers that have booked through The Activity People. This will be an approved use and can prevail where an agreement continues to exist between us. Any unlawful use will be dealt with by law without exception.

SEVERABILITY

All of the provisions, clauses and paragraphs in these Terms and Conditions should be read and construed independently of each other. If any provision, clause or paragraph in these Terms of Business is held to be invalid or unenforceable such provision, clause or paragraph will be struck out and the remaining provisions, clauses and paragraphs will remain in force.

STATUTORY RIGHTS

Your statutory rights are not affected.

JURISDICTION

These Terms and Conditions are governed by English law and you agree to submit to the exclusive jurisdiction of the English courts.

FORCE MAJEURE

The Activity People will not be liable for any delay or failure to carry out any of its rights, duties and responsibilities under these Terms and Conditions if the delay or failure is caused by circumstances outside of the control of The Activity People, including, but not limited to acts of god, war, civil disorder or industrial dispute.

WAIVER

Failure by The Activity People to enforce any of its rights under these Terms of Business is not to be regarded as a waiver of those rights unless the waiver is confirmed in writing. If The Activity People decides to waive any of its rights under these Terms of Business, this will not inhibit The Activity People from enforcing those rights at any or all times in the future.
